We
recommend that clients insert a Bluestone ADR arbitration clause
in every contract to ensure that any dispute is resolved with
minimum delay and expense.
"Bluestone
ADR arbitration clause:
In
the event that any disagreement or dispute arises between any
of the parties hereto with reference to this contract or any matter
arising hereunder and upon which the parties cannot resolve then
every such disagreement or dispute shall be referred to final
and binding arbitration before a sole arbitrator or panel of arbitrators
from Bluestone ADR (www.bluestoneadr.com)
and in accordance Bluestone ADR Rules of Arbitration and in accordance
with the provisions below.
The following
provisions shall govern any arbitration hereunder:
- Any party
to a dispute shall have the option to choose the Bluestone ADR
arbitration procedure (Bluestone ADR Arbitration Options) for
resolution of the dispute. Once a party chooses a Bluestone
ADR Arbitration Option the responding party may accept the Option
of arbitration chosen or suggest an alternative Option. Where
the parties cannot agree on the Bluestone ADR Arbitration Option
to be used for the dispute, the Bluestone ADR Full Arbitration-Three
Member Panel Option (Option F or equivalent) shall be used for
the arbitration.
- the reference
to arbitration shall be to one arbitrator agreed to by the disputing
parties or three (3) arbitrators, one of whom shall be chosen
by each the parties, the third being chosen by the arbitrators
selected by each of the parties;
- a decision
and any award shall be made in writing by the sole arbitrator
or where applicable by a majority of the panel of arbitrators.
There shall
be no right of appeal on facts or on law from any award of the
arbitration."
